1. Introduction and Scope

These Terms of Service ("Terms") govern your access to and use of the BrightBean API, website, and related services (collectively, the "Service") operated by InnovationCraft UG (haftungsbeschränkt), Im Vogelsang 22, 56743 Thür, Germany ("we", "us", or "BrightBean").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Definitions

"API" means the BrightBean application programming interface, including all endpoints, documentation, and related tools.
"API Key" means the unique authentication credential issued to you to access the API.
"User", "you", or "your" refers to the individual or entity accessing or using the Service.
"Plan" means the subscription tier you have selected (e.g., Free, Growth, or Scale), which determines your usage limits and available features.

3. Account Registration

To use the API, you must register for an account and obtain an API Key. You agree to:

Provide accurate and complete registration information.
Keep your API Key confidential and not share it with unauthorized third parties.
Notify us immediately at support@brightbean.xyz if you suspect unauthorized use of your API Key.
Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Service Description

BrightBean provides a YouTube Intelligence API that returns structured data derived from publicly available YouTube content. The Service includes endpoints for channel analytics, video metadata, content gap analysis, title scoring, thumbnail intelligence, and related features as described in our documentation.

We strive to maintain high availability and data accuracy but do not guarantee that the Service will be uninterrupted, error-free, or that all data will be complete or current at all times.

5. Plans and Usage Limits

5.1 Free Plan

The Free plan provides a one-time allocation of 500 API calls. This allocation is not recurring and does not reset. Once exhausted, you must upgrade to a paid plan to continue using the API.

5.2 Paid Plans

Paid plans (Growth and Scale) provide monthly recurring API call allocations as described on our pricing page. Usage limits reset at the beginning of each billing cycle.

5.3 Overages

If you exceed the API call limit for your plan, additional requests may be throttled or rejected until your allocation resets (for paid plans) or until you upgrade your plan.

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation.
Infringe upon the intellectual property rights of others.
Attempt to gain unauthorized access to the Service, other accounts, or related systems.
Interfere with or disrupt the integrity or performance of the Service.
Use automated tools to excessively burden the API beyond your plan limits (e.g., rapid-fire requests designed to circumvent rate limiting).
Resell, redistribute, or sublicense raw API responses without adding substantial value or transformation.
Use the Service in a manner that could harm, defame, or harass YouTube creators or any other individuals.

We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these acceptable use terms.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, algorithms, documentation, website content, and branding, is the intellectual property of InnovationCraft UG (haftungsbeschränkt) and is protected by applicable copyright and trademark laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

7.2 Your Use of API Data

Data returned by the API is derived from publicly available YouTube content. You are responsible for ensuring that your use of this data complies with all applicable laws, YouTube's Terms of Service, and the rights of content creators. We do not grant you any ownership rights over the data returned by the API.

8. Payment and Billing

Paid plans are billed on a monthly or annual basis, depending on your selection. All fees are stated in the currency indicated on our pricing page and are exclusive of applicable taxes unless otherwise stated.

Payment is due at the start of each billing cycle.
You authorize us (or our payment processor) to charge your provided payment method on a recurring basis.
If payment fails, we may suspend your access to the Service until payment is resolved.
Refunds are handled on a case-by-case basis. Contact support@brightbean.xyz for refund requests.

9. Cancellation and Termination

9.1 Cancellation by You

You may cancel your paid plan at any time. Upon cancellation, your access to paid features will continue until the end of your current billing cycle, after which your account will revert to the Free plan (if applicable) or be deactivated.

9.2 Termination by Us

We may suspend or terminate your account at any time if you breach these Terms, if required by law, or if we discontinue the Service. Where possible, we will provide reasonable notice before termination.

9.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We are not obligated to retain any of your data after termination, though we may retain certain data as required by law.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

The Service will meet your specific requirements.
The Service will be uninterrupted, timely, secure, or error-free.
The data returned by the API will be accurate, complete, or current.
Any defects in the Service will be corrected.

11. Limitation of Liability

To the fullest extent permitted by applicable law, InnovationCraft UG (haftungsbeschränkt) and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for all claims arising out of or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless InnovationCraft UG (haftungsbeschränkt), its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Koblenz, Germany, to the extent permitted by law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BrightBean regarding your use of the Service and supersede all prior agreements and understandings.
